This Legal Notice governs your use of www.sleepwellness.com.sg (the "Site") and your purchase and use of any product sold through it (the "Products"). It should be read together with our Terms of Service, Refund Policy, Shipping Policy and Privacy Policy. By using the Site or purchasing a Product, you confirm that you have read and accepted this Notice.

The Site is operated by SLEEP WELLNESS (UEN 53504950A), a company registered in Singapore, with its registered address at 60 Paya Lebar Road #07-54 Singapore 409051 ("Sleepwellness", "we", "us", "our").

1. No medical advice

Sleepwellness is a retailer of sleep and comfort accessories. We are not medical practitioners, sleep clinicians, or healthcare providers of any kind.

All content on the Site — including product descriptions, blog articles, guides, comparisons, email newsletters and responses to enquiries — is general information about comfort and everyday sleep habits. It is not medical advice, and it is not a diagnosis, treatment plan, or recommendation for any medical condition.

Nothing on the Site should be relied on as a substitute for advice from a qualified healthcare professional. If you have or suspect you have a health condition, or if a sleep problem is persistent, worsening or affecting your daily life, consult a doctor. Never delay seeking medical advice, or disregard advice you have received, because of something you read on the Site.

2. Our Products are not medical devices

Our Products are consumer comfort accessories. They are not medical devices, and they are not registered or licensed as medical devices with the Health Sciences Authority of Singapore or any equivalent regulator.

Our Products are not intended to diagnose, treat, cure, mitigate or prevent any disease or medical condition, and we make no claim that they do so.

Where a Product is described as supporting a position — for example an inclined or elevated resting position — that is a description of the Product's physical form and function. It is not a claim about any medical or physiological outcome.

3. No guarantee of results

Sleep is affected by many factors. People differ, and so do results.

We do not represent, warrant or guarantee that any Product will improve your sleep, comfort or wellbeing, or that it will produce any particular outcome for you. Any customer review, testimonial, or account of personal experience published on the Site describes that individual's experience only and is not a representation of typical results, nor a promise of what you will experience.

4. Suitability and your responsibility

You are responsible for deciding whether a Product is suitable for you.

Before using any Product, you should consider your own circumstances and, where relevant, seek professional advice. This applies particularly if you are pregnant, recovering from surgery or injury, have a diagnosed medical condition, are under medical supervision, or are buying on behalf of a child or a person in your care.

You must read and follow all instructions, warnings, sizing information and care instructions supplied with a Product or shown on its Site listing. You must use each Product only for its stated purpose and in the manner described.

Stop using a Product immediately and seek medical advice if you experience pain, irritation, discomfort, an allergic reaction, or any adverse effect.

Some Products contain plant extracts, adhesives, silicone, foam or other materials that may cause a reaction in sensitive individuals. Check the listed materials and ingredients before use. If you have known allergies or sensitivities, satisfy yourself that a Product is appropriate before purchasing.

Products are supplied for personal use. Products that sit in, on or against the body — including earplugs, eye masks, nasal strips and adhesive patches — are intended for use by one person and should not be shared.

5. Product information

We take reasonable care to describe our Products accurately, but we do not warrant that every description, specification, image or piece of information on the Site is complete, current or free from error.

Colours may appear differently across screens and devices. Measurements taken by hand may vary by up to the tolerance stated on the listing. Some information is supplied to us by manufacturers and suppliers, and we do not independently verify it.

We may correct errors, and change Product specifications, packaging, pricing and availability, at any time and without notice.

6. Third-party content

The Site may link to or reference third-party websites, articles, research or resources. We do not control that content, we do not endorse it, and we accept no responsibility for its accuracy or for anything you do in reliance on it. Any reference to third-party material is provided for general interest only.

7. Assumption of risk

To the extent permitted by law, you use our Products at your own risk, and you accept responsibility for using them in accordance with the instructions and warnings provided.

We are not responsible for loss or damage arising from misuse of a Product, use contrary to instructions, use by a person for whom the Product is not suitable, continued use after an adverse effect, modification or repair of a Product, or use of a Product beyond its stated wear time or lifespan.

8. Limitation of liability

Nothing in this Notice limits or excludes our liability for:

-        death or personal injury caused by our negligence;

-        fraud or fraudulent misrepresentation;

-        any other liability that cannot lawfully be limited or excluded under Singapore law, including your rights under the Consumer Protection (Fair Trading) Act 2003 and the Sale of Goods Act 1979.

Subject to the paragraph above, and to the fullest extent permitted by law:

(a) We exclude all warranties, conditions and terms implied by statute, common law or otherwise, other than those that cannot lawfully be excluded.

(b) We are not liable for any indirect, incidental, special or consequential loss, or for loss of profit, loss of income, loss of opportunity, loss of data, or loss arising from business interruption, however caused.

(c) Our total aggregate liability to you in connection with any Product, or with your use of the Site, however arising and whether in contract, tort (including negligence), breach of statutory duty or otherwise, is limited to the amount you actually paid to us for the Product giving rise to the claim.

(d) We are not liable for any failure or delay in performing our obligations that is caused by events beyond our reasonable control, including supplier failure, courier delay, industrial action, natural events, or restrictions imposed by a public authority.

9. Your statutory rights

Nothing in this Notice affects your statutory rights as a consumer under Singapore law.

In particular, if a Product does not conform to the contract at the time of delivery, you may have rights under Part 3 of the Consumer Protection (Fair Trading) Act 2003 to have it repaired or replaced, or, where that is not possible or proportionate, to a reduction in price or to rescind the contract. These rights apply for six months from delivery and are in addition to anything set out in our Refund Policy.

10. Goodwill refunds

Separately from, and in addition to, your statutory rights and our published Refund Policy, we may at our sole discretion offer a dollar-for-dollar refund or a replacement Product as a gesture of goodwill.

A goodwill refund is offered on a case-by-case basis. It is not an admission of fault, liability, defect or breach on our part. Offering a goodwill refund on one occasion does not create any obligation, practice or expectation that we will do so on another occasion, and does not vary this Notice or our Refund Policy.

Where we offer a goodwill refund, we may ask you to return the Product, provide proof of purchase, or provide photographs. Our maximum liability in respect of any goodwill refund is the amount you paid for the Product.

Nothing in this section limits your statutory rights, or our obligations, where a Product is faulty, not as described, or not of satisfactory quality.

11. Intellectual property

All content on the Site, including text, images, graphics, layout and branding, is owned by or licensed to Sleepwellness and is protected by copyright and other intellectual property rights. You may not reproduce, distribute or commercially exploit any part of it without our prior written consent.

12. Changes to this Notice

We may update this Notice from time to time. The version in force is the one published on the Site at the time of your purchase or use. Please check the "Last updated" date above.

13. Severability

If any provision of this Notice is found to be unlawful, void or unenforceable, that provision will be severed and the remaining provisions will continue in full force and effect.

14. Governing law and jurisdiction

This Notice, and any dispute or claim arising out of or in connection with it or with any Product, is governed by the laws of Singapore. The courts of Singapore have exclusive jurisdiction, save that nothing prevents a consumer from bringing a claim before the Small Claims Tribunals or the Consumers Association of Singapore (CASE) where eligible.
